Privacy policy
1. Scope
This policy describes how Janover Capital LLC ("Janover Capital," "we," "us") collects, uses, shares and protects information in connection with 1031.help (1031.help, the "Site"), which is operated by Janover Capital LLC. It applies to this Site only; janover.co, other Janover sites and third-party sites linked from here have their own policies. By using the Site you agree to this policy and to our Terms of use.
2. Information we collect
Forms you send. The Site has three request forms. Each sends only what you type or pick, and nothing is sent until you press the button.
- Ask a question: what you need (financing or a question), where your sale stands, expected sale price range, sale closing date, the state of the property you're selling, the type of property you're buying, the loan amount you think you need, your name, email, phone (optional) and your message.
- Replacement property financing: replacement price, loan amount, property type, replacement property state, sale closing date, your name, email and phone (optional).
- Contact: your name, email, phone (optional) and your message.
Every form also sends hidden fields: the page you sent it from, the consent sentence shown next to the button (so we keep a record of what you agreed to), the referring page and any campaign tags (such as utm_source) in the link that first brought you to the Site during that browser session, and an empty anti-spam field. Your browser keeps the referrer and campaign tags in session storage until you close the tab; they aren't sent anywhere unless you submit a form.
DST filing alerts. If you sign up on the DST tracker for an email when a new offering files, we store your email address, the alert you chose, the consent text you agreed to, the sign-up time and an unsubscribe token. No alert emails have been sent yet; the first one will ask you to confirm. Each email will carry a one-click unsubscribe link, and a separate link deletes the sign-up entirely.
Calculators. The deadline calculator, the capital gains calculator and the like-kind checker run entirely in your browser. The dates, prices and answers you enter are not sent to us or stored, and the calendar file the deadline tool makes is created on your device.
Downloads. The DST data files on the data page are ordinary file downloads; we don't ask who you are to download them.
Information collected automatically. Our hosting provider, Cloudflare, processes technical data such as your IP address, approximate location derived from it, browser and device type, the pages you request and the referring page, to deliver the Site and protect it from abuse.
The Site runs no analytics or advertising scripts.
3. How we use information
We use information to answer your request and, if you ask, to evaluate, size and arrange financing; to communicate with you about your request and our services, including by phone, text and email as described in section 5; to send the DST alerts you signed up for; to operate, secure and improve the Site; to comply with law, regulation and legal process; to enforce our Terms; to detect and prevent fraud, abuse and security incidents; and to protect the rights, property and safety of Janover Capital, our clients and others. We may use aggregated or de-identified information, which does not identify you, for any lawful purpose.
4. How we share information
We do not sell your personal information, and we do not share it with third parties for cross-context behavioral advertising. Your requests go to Janover Capital; we have no referral or lead-sharing arrangements with qualified intermediaries, CPAs, DST sponsors or broker-dealers, and we don't pass your details to them. We share information only as follows:
- Prospective lenders and transaction parties, only at your direction or with your consent, when you ask us to arrange financing (for example lenders, appraisers, title companies and counsel).
- Service providers that run the Site for us: Cloudflare (hosting, and the Cloudflare D1 database where form submissions and alert sign-ups are stored) and our email provider (which delivers your request to our team).
- Professional advisors, such as our lawyers, accountants and insurers, as reasonably needed.
- Legal and safety: when we believe disclosure is required by law, regulation, subpoena or legal process, or needed to enforce our agreements or protect the rights, property or safety of Janover Capital, our clients or others.
- Business transfers: in a merger, acquisition, financing, reorganization or sale of all or part of our business or assets.
5. Communications and your choices
If you give us contact details in a form, we may contact you by phone, text message and email about your request and our services, as described in the Terms of use. Consent to marketing communications is not a condition of any service. You can opt out of texts by replying STOP, opt out of marketing emails with the unsubscribe link, or contact us at (561) 559-4111 or hello@1031.help to update your preferences. We may still send non-promotional messages about an active request or transaction.
6. Cookies and analytics
The Site sets no cookies. It uses your browser's session storage only to remember, for the length of a visit, the referring page and campaign tags described in section 2. No analytics are enabled. The Site does not respond to "Do Not Track" signals. Where the law requires, we honor opt-out preference signals such as Global Privacy Control; as noted above, we don't sell personal information or share it for cross-context behavioral advertising.
7. Data retention
We keep information as long as reasonably necessary for the purposes in this policy, including transaction records, legal, tax and accounting requirements, disputes and enforcing agreements. Form submissions and alert sign-ups are stored in our Cloudflare database and deleted when no longer needed for your request or our records. When information is no longer needed, we take reasonable steps to delete or de-identify it.
8. Security
We use commercially reasonable administrative, technical and physical safeguards. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Please don't send Social Security numbers, account numbers or account credentials through the Site's forms; if a transaction needs sensitive documents, we will arrange a suitable channel.
9. Your privacy rights
Depending on where you live, you may have rights under privacy laws, such as the right to know or access the personal information we hold about you, correct it, delete it, get a portable copy, or opt out of certain processing. Much of what we handle relates to commercial transactions and may be exempt from some state privacy laws; we honor valid requests as the law requires. To make a request, contact hello@1031.help or (561) 559-4111 with your name, contact details and what you're asking for. We may need to verify your identity, and we won't discriminate against you for exercising your rights. Authorized agents may submit requests with proof of authorization.
10. Children
The Site is for adults dealing with investment and business real estate. It is not directed to, and we do not knowingly collect personal information from, anyone under 18. If you believe a minor has sent us information, contact us and we will delete it.
11. Users outside the United States
The Site is operated from and intended for users in the United States. If you use it from elsewhere, your information will be transferred to, stored in and processed in the United States, where privacy laws may differ from yours.
12. Third-party links
The Site links to government and legal sources (the IRS, the Electronic Code of Federal Regulations, Cornell's Legal Information Institute, state revenue departments and legislatures, court sites) and to SEC EDGAR for each DST filing. This policy doesn't apply to those sites, and we aren't responsible for their privacy practices.
13. Changes to this policy
We may update this policy. The revised version will be posted here with a new effective date. Your continued use of the Site after posting means you accept it.
